Who This Covers

These terms apply to all services and merchandise offered by TD Service LLC, based in Peoria, Illinois. By requesting a quote, placing an order, or booking a service, you agree to these terms.

Service Terms

TD Service LLC offers owner-operated hauling — junk removal, estate & apartment cleanouts, scrap metal pickup, and same-day hauling when the schedule allows. Retail sales of goods (merchandise, food, resale items) will be added once the in-house shop opens; these terms cover those services prospectively. All service pricing is based on quotes provided before work begins.

Quotes: All quotes are estimates. Final price may adjust if the actual scope of work differs significantly from what was described. You'll be informed before any extra charges are added.
Payment: Payment is due upon completion of work unless otherwise agreed in writing. Accepted methods: Cash, PayPal, or Clover (card terminal).
Cancellations:
- Same-day cancellations (cancelled on the date of the scheduled service) are subject to a 35% cancellation fee based on the agreed service price. The fee compensates for held availability and trip preparation.
- Rescheduling instead of cancelling is free — no fee applies if you move the booking to a different date.
- Two cancellations by the same customer (matched by email or phone number) will result in your account being added to our "Do Not Serve" list. Subsequent booking and chat attempts will be automatically declined. To dispute or appeal, email contact@tdservicellc.com.
- Cancellations and reschedules can be made anytime via the booking link emailed to you. Last-minute cancellations (under 2 hours before scheduled start) on large jobs may incur additional trip fees at TD Service's discretion.
Refunds on services: Once a receipt is signed and payment is collected, all service sales are final. If you're not happy with the result, contact us the same day — we'll come back and make it right at no extra charge. We will not leave you with work you're not satisfied with.
Satisfaction: Photo / walkthrough confirmation happens before you pay. No payment is collected until you've approved the completed work.

In-Person Self-Checkout Kiosk Sales — Refund & Return Policy

Short version: Items sold in-person at our Self-Checkout Kiosk can be refunded the same day with the receipt, in original condition. After 24 hours, all sales are final.

Same-day refunds: Bring your receipt and the item in unused/original condition the same day to the location of purchase. We'll process a full refund to the original payment method (Cash or PayPal).
After 24 hours: All sales are final. We cannot accept returns or exchanges past the same-day window.
Defective items: If a product is defective, contact us within 30 days and we'll replace or refund it regardless of the same-day window.
Voided transactions: If a transaction is voided by the owner-operator before the customer leaves (e.g., wrong item added by mistake), the sale is fully reversed — no refund needed.
Records: Every kiosk sale is logged with a unique transaction number. Voids and refunds are tracked separately and excluded from sales totals.

Drop-Ship Model & Merchant of Record

Plain English: TD Service LLC is the merchant of record on every order — you buy from us, we charge you, and we handle support and refunds. The actual physical item ships to you directly from one of our fulfillment partners. We never physically touch most items before they reach you.

This drop-ship model means:

You only pay TD Service LLC. Your order, charges, taxes, refunds, and support all flow through us. Suppliers don't bill you directly.
Fulfillment partners ship the physical product. Custom apparel and accessories are produced and shipped by a print-on-demand partner. General goods (furniture, outdoor, home, pet, etc.) ship from our fulfillment network.
We resolve issues for you. If something arrives damaged, wrong, or defective, contact us — not the supplier. We coordinate with the supplier to make it right (replacement, refund, or credit per our Refund & Return Policy).
FTC disclosure compliance. Per FTC business-opportunity rules, we disclose that products may ship from our supplier's facility, not from a TD Service warehouse.

Food Orders — Pre-Packaged Retail Disclosure

⚠ Read before purchasing food: TD Service LLC sells only pre-packaged, manufacturer-sealed retail snacks and beverages over the counter at our location. We do not prepare, cook, package, or store food in-house. We do not operate a kitchen and we do not produce food under Illinois Cottage Food Law. All food items are sold in their original manufacturer packaging exactly as received from the producer.

Allergen information: Allergen and ingredient information appears on the original manufacturer label of each item. Items may be processed in facilities that also handle common allergens (peanuts, tree nuts, dairy, eggs, soy, wheat, fish, shellfish, sesame). If you have a serious food allergy, read each label carefully before purchase.
Cold-held items: Refrigerated items are kept at ≤41 °F per Illinois Department of Public Health regulations under our IL Retail Food Establishment Permit (when issued — see /food.html for current status).
Storage after purchase: Once you take possession of food, you are responsible for proper storage and consumption per the manufacturer's printed instructions.
Spoilage / damaged packaging: If a sealed package is damaged or spoiled at point of sale, return it for an exchange or refund before leaving the premises. After leaving the premises, manufacturer warranties apply.
Limitation: TD Service LLC's total liability for any food-related claim is limited to the purchase price of the affected item. See the broader Limitation of Liability section below.
Reporting illness: If you suspect food-borne illness from a TD Service purchase, contact us at (309) 460-3999 AND consider reporting to the Illinois Department of Public Health.

Merchandise — Refund & Return Policy

Short version: If your item arrives damaged or with a print defect, we'll replace it free. Because all merch is made to order, we can't accept returns for buyer's remorse or size exchanges — so please double-check sizing charts before ordering. Full policy: Refund & Return Policy.

All TD Service LLC merchandise is custom printed on demand by our fulfillment partner and made specifically for your order. This means:

Defective or damaged items: If your order arrives with a manufacturing defect, wrong item, or shipping damage, contact us within 30 days of delivery with a photo. We'll arrange a free replacement at no cost to you.
Lost packages: If your tracking shows delivered but nothing arrived, contact us within 30 days. We'll work with our fulfillment partner to investigate and reship if confirmed lost.
Wrong size ordered: Because items are printed on demand, we cannot accept size exchanges. Please use the size guide shown on each product before ordering.
Change of mind: Refunds are not available once production has begun with our fulfillment partner, as production starts immediately.
Photo approval policy: For certain custom orders, We'll send you a mockup photo for approval before charging you. Once you approve and payment is made, the order is final.

Resale Items — Refund & Return Policy

Short version: Resale items are sold as-is. All resale sales are final. Items are inspected before listing; if you arrive to pick up an item and it's not as described, you can decline before payment.

As-is condition: Every resale item is inspected before listing and described accurately. The buyer accepts the item in its current condition at the time of meetup.
Inspect before paying: You can examine the item at meetup before any money changes hands. If it's not what you expected, you can walk away with no obligation.
Once paid, all sales are final: No returns, exchanges, or refunds after payment is accepted.
Consignor payouts: If you consigned an item to TD Service LLC for resale, payout is issued via Cash or PayPal once the item sells. Items priced $50–$500 split 50/50; items over $500 are by prior arrangement only.
Tax reporting: Consignor payouts over $600 in a calendar year may be reported on IRS Form 1099-NEC.

Merchandise — Shipping Policy

All merchandise is printed and shipped by our fulfillment partner directly to your door. TD Service LLC never handles physical inventory.

Production time: Most items take 2–5 business days to print before shipping.
Shipping time: Standard shipping within the US typically takes 3–7 business days after production. Expedited options may be available on request.
Tracking: You'll receive a tracking number by email once your order ships.
Shipping cost: Shipping is calculated per order based on item type and destination. It will be quoted to you before payment is collected.
International orders: Contact us first — international shipping is available but requires a custom quote.

Our fulfillment partner ships from facilities in the US, EU, and elsewhere depending on your location and the item. Most US orders ship from within the United States.

Pricing & Availability

Prices shown on this website are in US dollars and are subject to change without notice. TD Service LLC reserves the right to discontinue any product or service at any time. For services, the quoted price at time of booking is honored.

Service Estimates & Add-On Work

Short version: Online prices are estimates based on typical scope. If your job is significantly larger or different than described, we'll quote the new total before doing the extra work. No surprise charges, ever.

Estimates are good-faith approximations based on the description provided at booking. Final price may vary if actual scope differs (extra haul, hidden growth, additional debris, deeper repairs, etc.).
Material price changes: If a job requires materials we have to source (mulch, dump fees, parts), the customer is shown the actual material cost; TD Service LLC does not mark up pass-through materials beyond a stated rate.
Add-on approval: Any work beyond the originally booked scope is presented to the customer as a separate written or verbal quote and is performed only after explicit approval. The customer may decline add-on work and pay only for the originally booked scope.
Quoted prices honored: Once you've confirmed a price for the booked scope, that price is fixed for that scope of work.

Right to Refuse Service

TD Service LLC reserves the right to decline, pause, or terminate any service at our sole discretion if continuing would create unsafe, unlawful, or unreasonable conditions. This includes but is not limited to:

Unsafe site conditions: structurally unsound trees or buildings, hazardous-waste containers (paint, oil, chemicals, asbestos, lead, mercury, batteries, propane tanks) presented as ordinary haul, hostile or aggressive animals on premises, severe weather risking worker safety.
Items requiring special permits: hazardous waste, medical waste, biohazard cleanup, vehicles requiring titles, refrigerants, mattresses in regulated municipalities — these require licensed disposal and are referred to specialists.
Illegal items: firearms, ammunition, controlled substances, stolen property, or anything we have reason to believe is illegal. We will report obvious illegal activity to law enforcement when required by law.
Threatening behavior: harassment, threats, intoxication, or sexual misconduct toward TD Service LLC personnel results in immediate refusal and a permanent "Do Not Serve" flag.
Misrepresented scope: if the booked job is materially different from what was described (e.g., booked "single-item pickup" but the actual job is a full property cleanout), we may decline and refund.

If we decline service before work begins, you receive a full refund with no fee. If we terminate mid-job for safety reasons, you are charged only for the work actually completed.

Sweepstakes Winners — Photo & Likeness Release

By accepting a TD Service LLC sweepstakes prize (Promotion A · Monthly Sweepstakes, Promotion C · Milestone, Promotion D · Monthly Cash Drawing, or any future sponsored prize), the winner grants TD Service LLC a non-exclusive, royalty-free, worldwide license to use the winner's first name, city/state, and likeness (photo or video taken at prize handoff if voluntarily submitted) for promotional purposes including social media posts, website winner announcements, press releases, and printed marketing materials, for a period of two (2) years from the prize-claim date.

TD Service LLC will not publish a winner's full name, address, phone number, email, or other personally identifying details without separate written consent.
Winners who do not wish to be featured in promotional materials may indicate so in writing at the time of claim. Their prize will be paid as normal but their identity will not be published.
Photos / videos of winners are voluntary. We will not photograph anyone who declines.

Limitation of Liability

To the maximum extent permitted by Illinois and federal law, TD Service LLC's total liability for any claim arising out of or related to any service, merchandise, sweepstakes, or use of this website is limited to the amount the customer actually paid for the specific service or item giving rise to the claim, and shall in no case exceed five hundred dollars ($500.00) total.

TD Service LLC shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to lost profits, lost data, loss of goodwill, business interruption, or property damage beyond the value of the work performed, even if TD Service LLC has been advised of the possibility of such damages.

For services performed on customer property (junk removal, estate & apartment cleanouts, scrap pickup, same-day hauling), TD Service LLC takes reasonable care to perform the work safely and professionally. Any accidental damage caused directly by TD Service LLC will be discussed in good faith and addressed fairly, but TD Service LLC's liability is limited as stated above. The customer is responsible for marking sprinkler heads, invisible fences, septic lids, underground utilities, and any other concealed property hazards before work begins.

Disclaimer of Warranties

All services and merchandise are provided "AS-IS" and "AS AVAILABLE" without warranty of any kind, express or implied. To the fullest extent allowed by law, TD Service LLC disclaims all warranties including but not limited to the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Resale items are sold strictly as-is — no warranty, express or implied, is offered on any used item. Buyers inspect resale items before payment and accept them in their stated condition.

TD Service LLC makes no guarantee of specific results, completion times, or outcomes. Quoted timelines are estimates and may be affected by weather, supply availability, scheduling conflicts, or circumstances beyond our control.

Indemnification

The customer agrees to indemnify and hold harmless TD Service LLC and its owner-operator (and any future employees or licensed contractors at the time they may be engaged) from any third-party claims, losses, damages, or expenses (including reasonable attorney fees) arising out of: (1) the customer's misuse of any service or product, (2) the customer's failure to disclose property hazards before service work, (3) the customer's violation of these terms, or (4) the customer's violation of any law or third-party right.

Force Majeure

TD Service LLC is not liable for delays, cancellations, or non-performance caused by circumstances beyond reasonable control, including but not limited to severe weather, natural disasters, acts of God, government actions, civil unrest, supply chain failure, third-party fulfillment delays, pandemic, illness, or accidents. Service may be rescheduled at no extra charge under these circumstances.

Independent Business Status

TD Service LLC is an independent Illinois-registered limited liability company, owner-operated. The owner performs all work directly on behalf of the LLC and is not an employee or contractor of the customer. Customer is not responsible for the LLC's taxes, insurance, or worker classification.

TD Service LLC is a waste and debris hauling contractor and retail seller of goods. We are not a licensed security company, plumber, electrician, HVAC contractor, roofer, lawn or landscaping contractor, or general contractor, and we do not offer those services. If a customer's project requires a licensed trade, the customer should engage that licensed professional directly.

Acceptable Use of This Website

By using tdservicellc.com (the "Site"), you agree NOT to:

Submit fraudulent bookings, fake reviews, fake sweepstakes entries, or false statements about your identity or location.
Use automated tools (bots, scrapers, crawlers, headless browsers) to access the Site without our prior written consent — search-engine indexing crawlers obeying robots.txt are exempt.
Attempt to bypass any security feature, authentication wall, rate limit, or content protection.
Reverse-engineer, decompile, or disassemble any portion of the Site or its source code.
Upload viruses, malware, or any malicious code, or attempt to damage, disrupt, or overload our infrastructure (DoS/DDoS).
Harass, threaten, defame, or stalk other users or the LLC's owner-operator (or any future staff).
Use the Site to violate any local, state, federal, or international law.
Resell, sublicense, or commercially redistribute any content from the Site without permission.
Misrepresent your relationship with TD Service LLC (e.g., claiming to be an authorized reseller, affiliate, or representative when you are not).

TD Service LLC may, at its sole discretion, suspend or permanently ban any user found violating this policy, with or without notice, and report serious violations to law enforcement.

DMCA Copyright Notice

TD Service LLC respects the intellectual-property rights of others and complies with the Digital Millennium Copyright Act (17 U.S.C. § 512). If you believe content on the Site infringes your copyright, send a written DMCA takedown notice including: (1) your physical or electronic signature, (2) identification of the copyrighted work, (3) identification of the allegedly infringing material with a URL, (4) your contact information, (5) a statement of good-faith belief, and (6) a statement of accuracy under penalty of perjury.

Repeat infringers will have access to the Site permanently terminated.

State Privacy Rights (CCPA / VCDPA / and similar laws)

If you are a resident of California, Virginia, Colorado, Connecticut, Utah, or another state with a comprehensive privacy law, you may have rights including:

Right to know — what personal information we collect and how we use it (see our Privacy Policy).
Right to delete — request deletion of personal information we hold about you.
Right to correct — fix inaccurate personal information.
Right to opt out of sale or sharing — TD Service LLC does not sell or share personal information with third-party advertisers; this right is informational only.
Right to non-discrimination — we will not deny service or charge different prices for exercising these rights.

To exercise any of these rights, email contact@tdservicellc.com with the subject line "Privacy Rights Request" and we will respond within 45 days as required by law. We may need to verify your identity before processing the request.

Children's Privacy

The Site is not intended for users under 18 years of age. Sweepstakes participation requires age 18+. We do not knowingly collect personal information from anyone under 13. If you believe a child under 13 has provided us information, contact us immediately and we will delete it.

Assumption of Risk for Customer Property

The customer understands that junk removal, estate & apartment cleanouts, scrap pickup, and same-day hauling involve inherent risks to the property being serviced, including but not limited to: scratches on doorways or walls from carrying items, dust and debris from breaking down bulky items, minor turf compression from vehicles or carts, and ordinary wear-and-tear of access points. By booking these services, the customer accepts these inherent risks. TD Service LLC takes reasonable care to minimize incidents but cannot guarantee a zero-risk operation on customer property.

The customer is responsible for marking sprinkler heads, invisible-fence wires, septic lids, French drains, gas lines, low-voltage cables, and any other concealed property hazards before service begins. Damage to unmarked concealed hazards is not the responsibility of TD Service LLC.

Customer Property Damage — Claim Cap & Reporting Window

Plain-English summary: If we damage something of yours while doing your job, tell us within 7 days, send a photo, and we'll repair, replace, or reimburse it up to the cap below. After 7 days, the claim is closed. This is faster, fairer, and more predictable than going to court — and it preserves your right to small-claims court for anything we can't resolve.

Claim cap. Subject to the Limitation of Liability section above, TD Service LLC's total liability for accidental physical damage to customer property caused by our negligence during the performance of a service shall not exceed the lesser of:

The actual repair or replacement cost (depreciated fair-market value for used items), OR
$2,500 per incident, OR
3× the price paid for the job that caused the damage.

This cap does not apply to: (a) damage caused by gross negligence or willful misconduct; (b) bodily injury claims; (c) claims that any law prohibits us from capping. The cap is in addition to, and not in lieu of, the broader Limitation of Liability section.

Reporting window. A customer property-damage claim must be reported in writing within 7 calendar days of the service date. Reports after this window are closed by default because we lose the ability to confirm what happened, whether the damage pre-existed, and whether the crew can dispute the account. To preserve your claim:

Email contact@tdservicellc.com or call (309) 460-3999 within 7 days.
Send dated photos of the damage. Where possible, include a photo of the same area before the service.
Provide the job date and a brief description of what happened.
Do not destroy or fully repair the damaged item before we acknowledge the claim, except where safety requires immediate action.

Our response. We will acknowledge in writing within 3 business days, complete an assessment within 10 business days, and issue a repair plan, replacement, or reimbursement decision within 30 days of the original report. If we deny a claim, the denial includes our reason; you remain free to pursue any remedy not waived by the rest of these Terms (including the small-claims-court carve-out below).

What's covered. Items the owner-operator physically handled or worked next to that suffered visible, identifiable damage attributable to the service. Not covered: pre-existing wear; cosmetic issues not photographed before service; damage to unmarked concealed property (see preceding section); damage caused by the customer or third parties present at the site; consequential, indirect, or sentimental-value claims beyond actual repair/replacement cost.

Insurance coordination. If the damage exceeds the cap or is denied, you remain free to file with your homeowners' or renters' insurer; we will provide documentation needed to support your claim with your insurer at no charge.

Governing Law & Disputes

These terms are governed by the laws of the State of Illinois, without regard to conflict-of-law rules.

The parties agree to attempt good-faith resolution of any dispute by direct communication for at least 30 days before initiating any formal legal action. Send written notice of any dispute to contact@tdservicellc.com with subject line "Notice of Dispute" describing the issue and your proposed resolution.

⚖ Mandatory Arbitration & Class-Action Waiver — Please Read Carefully

Plain-English summary: Most disputes between you and TD Service LLC will be resolved by individual arbitration, not in court, and not as a class action. You can opt out of arbitration within 30 days of first using our services by emailing us. Small-claims-court disputes (under $5,000) are not affected. This section significantly affects your legal rights.

Binding arbitration. Any dispute, claim, or controversy arising out of or relating to these terms, the Site, our services, our merchandise, or any sweepstakes (a "Dispute") that cannot be resolved through informal good-faith negotiation under the section above shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules in effect at the time the Dispute is filed. The arbitration shall take place in Peoria County, Illinois, or by remote video at the customer's election. Judgment on the award may be entered in any court of competent jurisdiction.

Class-action waiver. You and TD Service LLC each agree to bring claims against the other only in your or its individual capacity, and NOT as a plaintiff or class member in any purported class, collective, consolidated, mass, representative, or private-attorney-general proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding. If this class-action waiver is held unenforceable, then the entirety of this Arbitration section is null and void.

Small-claims exception. Either party may bring an individual action in small-claims court (Peoria County, Illinois) for any Dispute within the small-claims jurisdictional limits, in lieu of arbitration.

30-day opt-out. You may opt out of this Arbitration section by emailing contact@tdservicellc.com with subject line "Arbitration Opt-Out" within 30 days of your first booking, purchase, or sweepstakes entry. Include your full name and the email address associated with your account. Opting out has no effect on the rest of these Terms.

Court-only carve-outs. Notwithstanding the above, either party may bring a court action seeking injunctive or equitable relief for actual or threatened infringement of intellectual-property rights, breach of confidentiality, or violation of the Acceptable Use Policy. Disputes over the enforceability of this Arbitration section itself may also be brought in court.

Survival. This Arbitration section survives termination of these Terms, your account, and any business relationship with TD Service LLC.

Payment Processors & Card Data

TD Service LLC uses third-party payment processors (PayPal, Clover, and similar PCI-DSS compliant providers) to handle all card and digital-wallet payments. We do NOT store full credit/debit card numbers on our servers. Card transactions are tokenized by the processor and only the last 4 digits are retained for receipts and dispute resolution. Disputes regarding card transactions are governed by the cardholder agreement with your card issuer.

Modifications to These Terms

TD Service LLC may modify these Terms at any time. Material changes (changes to refund policy, arbitration, governing law, or any provision affecting your legal rights) will be communicated by: (1) posting a revised version with an updated "Effective Date" at the top, AND (2) where reasonably practical, an email notice to active customers at the address on file. Your continued use of the Site or services after the effective date of a change constitutes acceptance. If you do not agree to a material change, you must stop using the Site and request deletion of your account.

Severability, Waiver & Entire Agreement

If any provision of these terms is found unenforceable, the remaining provisions shall remain in full force and effect, except where the unenforceability of the Class-Action Waiver voids the entire Arbitration section as stated above. No failure or delay by TD Service LLC to enforce any provision is a waiver of that provision. These terms (together with the Privacy Policy, Sweepstakes Official Rules, and any service-specific addenda) constitute the entire agreement between the customer and TD Service LLC and supersede all prior agreements, representations, and understandings.

Assignment. You may not assign your rights or obligations under these Terms without our prior written consent. TD Service LLC may freely assign its rights and obligations, including in connection with a merger, acquisition, sale of assets, or operation of law. Such assignment does not change your rights under these Terms.

Headings. Section headings are for convenience only and do not affect interpretation.

Survival. Provisions intended to survive termination — including Limitation of Liability, Disclaimer of Warranties, Indemnification, Arbitration & Class-Action Waiver, Governing Law, and these miscellaneous provisions — shall survive any expiration or termination of these Terms.
