Terms, Refund & Shipping Policy

Who This Covers

These terms apply to all services and merchandise offered by TD Service LLC, based in Peoria, Illinois. By requesting a quote, placing an order, or booking a service, you agree to these terms.

Service Terms

TD Service LLC offers owner-operated hauling — junk removal, estate & apartment cleanouts, scrap metal pickup, and same-day hauling when the schedule allows. Retail sales of goods (merchandise, food, resale items) will be added once the in-house shop opens; these terms cover those services prospectively. All service pricing is based on quotes provided before work begins.

In-Person Self-Checkout Kiosk Sales — Refund & Return Policy

Short version: Items sold in-person at our Self-Checkout Kiosk can be refunded the same day with the receipt, in original condition. After 24 hours, all sales are final.

Drop-Ship Model & Merchant of Record

Plain English: TD Service LLC is the merchant of record on every order — you buy from us, we charge you, and we handle support and refunds. The actual physical item ships to you directly from one of our fulfillment partners. We never physically touch most items before they reach you.

Food Orders — Pre-Packaged Retail Disclosure

⚠ Read before purchasing food: TD Service LLC sells only pre-packaged, manufacturer-sealed retail snacks and beverages over the counter at our location. We do not prepare, cook, package, or store food in-house. We do not operate a kitchen and we do not produce food under Illinois Cottage Food Law. All food items are sold in their original manufacturer packaging exactly as received from the producer.

Merchandise — Refund & Return Policy

Short version: If your item arrives damaged or with a print defect, we'll replace it free. Because all merch is made to order, we can't accept returns for buyer's remorse or size exchanges — so please double-check sizing charts before ordering. Full policy: Refund & Return Policy.

All TD Service LLC merchandise is custom printed on demand by our fulfillment partner and made specifically for your order. This means:

Resale Items — Refund & Return Policy

Short version: Resale items are sold as-is. All resale sales are final. Items are inspected before listing; if you arrive to pick up an item and it's not as described, you can decline before payment.

Merchandise — Shipping Policy

All merchandise is printed and shipped by our fulfillment partner directly to your door. TD Service LLC never handles physical inventory.

Our fulfillment partner ships from facilities in the US, EU, and elsewhere depending on your location and the item. Most US orders ship from within the United States.

Pricing & Availability

Prices shown on this website are in US dollars and are subject to change without notice. TD Service LLC reserves the right to discontinue any product or service at any time. For services, the quoted price at time of booking is honored.

Service Estimates & Add-On Work

Short version: Online prices are estimates based on typical scope. If your job is significantly larger or different than described, we'll quote the new total before doing the extra work. No surprise charges, ever.

Right to Refuse Service

TD Service LLC reserves the right to decline, pause, or terminate any service at our sole discretion if continuing would create unsafe, unlawful, or unreasonable conditions. This includes but is not limited to:

If we decline service before work begins, you receive a full refund with no fee. If we terminate mid-job for safety reasons, you are charged only for the work actually completed.

Sweepstakes Winners — Photo & Likeness Release

By accepting a TD Service LLC sweepstakes prize (Promotion A · Monthly Sweepstakes, Promotion C · Milestone, Promotion D · Monthly Cash Drawing, or any future sponsored prize), the winner grants TD Service LLC a non-exclusive, royalty-free, worldwide license to use the winner's first name, city/state, and likeness (photo or video taken at prize handoff if voluntarily submitted) for promotional purposes including social media posts, website winner announcements, press releases, and printed marketing materials, for a period of two (2) years from the prize-claim date.

Limitation of Liability

To the maximum extent permitted by Illinois and federal law, TD Service LLC's total liability for any claim arising out of or related to any service, merchandise, sweepstakes, or use of this website is limited to the amount the customer actually paid for the specific service or item giving rise to the claim, and shall in no case exceed five hundred dollars ($500.00) total.

TD Service LLC shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to lost profits, lost data, loss of goodwill, business interruption, or property damage beyond the value of the work performed, even if TD Service LLC has been advised of the possibility of such damages.

For services performed on customer property (junk removal, estate & apartment cleanouts, scrap pickup, same-day hauling), TD Service LLC takes reasonable care to perform the work safely and professionally. Any accidental damage caused directly by TD Service LLC will be discussed in good faith and addressed fairly, but TD Service LLC's liability is limited as stated above. The customer is responsible for marking sprinkler heads, invisible fences, septic lids, underground utilities, and any other concealed property hazards before work begins.

Disclaimer of Warranties

All services and merchandise are provided "AS-IS" and "AS AVAILABLE" without warranty of any kind, express or implied. To the fullest extent allowed by law, TD Service LLC disclaims all warranties including but not limited to the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Resale items are sold strictly as-is — no warranty, express or implied, is offered on any used item. Buyers inspect resale items before payment and accept them in their stated condition.

TD Service LLC makes no guarantee of specific results, completion times, or outcomes. Quoted timelines are estimates and may be affected by weather, supply availability, scheduling conflicts, or circumstances beyond our control.

Indemnification

The customer agrees to indemnify and hold harmless TD Service LLC and its owner-operator (and any future employees or licensed contractors at the time they may be engaged) from any third-party claims, losses, damages, or expenses (including reasonable attorney fees) arising out of: (1) the customer's misuse of any service or product, (2) the customer's failure to disclose property hazards before service work, (3) the customer's violation of these terms, or (4) the customer's violation of any law or third-party right.

Force Majeure

TD Service LLC is not liable for delays, cancellations, or non-performance caused by circumstances beyond reasonable control, including but not limited to severe weather, natural disasters, acts of God, government actions, civil unrest, supply chain failure, third-party fulfillment delays, pandemic, illness, or accidents. Service may be rescheduled at no extra charge under these circumstances.

Independent Business Status

TD Service LLC is an independent Illinois-registered limited liability company, owner-operated. The owner performs all work directly on behalf of the LLC and is not an employee or contractor of the customer. Customer is not responsible for the LLC's taxes, insurance, or worker classification.

TD Service LLC is a waste and debris hauling contractor and retail seller of goods. We are not a licensed security company, plumber, electrician, HVAC contractor, roofer, lawn or landscaping contractor, or general contractor, and we do not offer those services. If a customer's project requires a licensed trade, the customer should engage that licensed professional directly.

Acceptable Use of This Website

By using tdservicellc.com (the "Site"), you agree NOT to:

TD Service LLC may, at its sole discretion, suspend or permanently ban any user found violating this policy, with or without notice, and report serious violations to law enforcement.

DMCA Copyright Notice

TD Service LLC respects the intellectual-property rights of others and complies with the Digital Millennium Copyright Act (17 U.S.C. § 512). If you believe content on the Site infringes your copyright, send a written DMCA takedown notice including: (1) your physical or electronic signature, (2) identification of the copyrighted work, (3) identification of the allegedly infringing material with a URL, (4) your contact information, (5) a statement of good-faith belief, and (6) a statement of accuracy under penalty of perjury.

State Privacy Rights (CCPA / VCDPA / and similar laws)

If you are a resident of California, Virginia, Colorado, Connecticut, Utah, or another state with a comprehensive privacy law, you may have rights including:

Children's Privacy

The Site is not intended for users under 18 years of age. Sweepstakes participation requires age 18+. We do not knowingly collect personal information from anyone under 13. If you believe a child under 13 has provided us information, contact us immediately and we will delete it.

Assumption of Risk for Customer Property

The customer understands that junk removal, estate & apartment cleanouts, scrap pickup, and same-day hauling involve inherent risks to the property being serviced, including but not limited to: scratches on doorways or walls from carrying items, dust and debris from breaking down bulky items, minor turf compression from vehicles or carts, and ordinary wear-and-tear of access points. By booking these services, the customer accepts these inherent risks. TD Service LLC takes reasonable care to minimize incidents but cannot guarantee a zero-risk operation on customer property.

The customer is responsible for marking sprinkler heads, invisible-fence wires, septic lids, French drains, gas lines, low-voltage cables, and any other concealed property hazards before service begins. Damage to unmarked concealed hazards is not the responsibility of TD Service LLC.

Customer Property Damage — Claim Cap & Reporting Window

Plain-English summary: If we damage something of yours while doing your job, tell us within 7 days, send a photo, and we'll repair, replace, or reimburse it up to the cap below. After 7 days, the claim is closed. This is faster, fairer, and more predictable than going to court — and it preserves your right to small-claims court for anything we can't resolve.

Claim cap. Subject to the Limitation of Liability section above, TD Service LLC's total liability for accidental physical damage to customer property caused by our negligence during the performance of a service shall not exceed the lesser of:

This cap does not apply to: (a) damage caused by gross negligence or willful misconduct; (b) bodily injury claims; (c) claims that any law prohibits us from capping. The cap is in addition to, and not in lieu of, the broader Limitation of Liability section.

Reporting window. A customer property-damage claim must be reported in writing within 7 calendar days of the service date. Reports after this window are closed by default because we lose the ability to confirm what happened, whether the damage pre-existed, and whether the crew can dispute the account. To preserve your claim:

  1. Email contact@tdservicellc.com or call (309) 460-3999 within 7 days.
  2. Send dated photos of the damage. Where possible, include a photo of the same area before the service.
  3. Provide the job date and a brief description of what happened.
  4. Do not destroy or fully repair the damaged item before we acknowledge the claim, except where safety requires immediate action.

Our response. We will acknowledge in writing within 3 business days, complete an assessment within 10 business days, and issue a repair plan, replacement, or reimbursement decision within 30 days of the original report. If we deny a claim, the denial includes our reason; you remain free to pursue any remedy not waived by the rest of these Terms (including the small-claims-court carve-out below).

What's covered. Items the owner-operator physically handled or worked next to that suffered visible, identifiable damage attributable to the service. Not covered: pre-existing wear; cosmetic issues not photographed before service; damage to unmarked concealed property (see preceding section); damage caused by the customer or third parties present at the site; consequential, indirect, or sentimental-value claims beyond actual repair/replacement cost.

Insurance coordination. If the damage exceeds the cap or is denied, you remain free to file with your homeowners' or renters' insurer; we will provide documentation needed to support your claim with your insurer at no charge.

Governing Law & Disputes

These terms are governed by the laws of the State of Illinois, without regard to conflict-of-law rules.

The parties agree to attempt good-faith resolution of any dispute by direct communication for at least 30 days before initiating any formal legal action. Send written notice of any dispute to contact@tdservicellc.com with subject line "Notice of Dispute" describing the issue and your proposed resolution.

⚖ Mandatory Arbitration & Class-Action Waiver — Please Read Carefully

Plain-English summary: Most disputes between you and TD Service LLC will be resolved by individual arbitration, not in court, and not as a class action. You can opt out of arbitration within 30 days of first using our services by emailing us. Small-claims-court disputes (under $5,000) are not affected. This section significantly affects your legal rights.

Binding arbitration. Any dispute, claim, or controversy arising out of or relating to these terms, the Site, our services, our merchandise, or any sweepstakes (a "Dispute") that cannot be resolved through informal good-faith negotiation under the section above shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules in effect at the time the Dispute is filed. The arbitration shall take place in Peoria County, Illinois, or by remote video at the customer's election. Judgment on the award may be entered in any court of competent jurisdiction.

Class-action waiver. You and TD Service LLC each agree to bring claims against the other only in your or its individual capacity, and NOT as a plaintiff or class member in any purported class, collective, consolidated, mass, representative, or private-attorney-general proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding. If this class-action waiver is held unenforceable, then the entirety of this Arbitration section is null and void.

Small-claims exception. Either party may bring an individual action in small-claims court (Peoria County, Illinois) for any Dispute within the small-claims jurisdictional limits, in lieu of arbitration.

30-day opt-out. You may opt out of this Arbitration section by emailing contact@tdservicellc.com with subject line "Arbitration Opt-Out" within 30 days of your first booking, purchase, or sweepstakes entry. Include your full name and the email address associated with your account. Opting out has no effect on the rest of these Terms.

Court-only carve-outs. Notwithstanding the above, either party may bring a court action seeking injunctive or equitable relief for actual or threatened infringement of intellectual-property rights, breach of confidentiality, or violation of the Acceptable Use Policy. Disputes over the enforceability of this Arbitration section itself may also be brought in court.

Survival. This Arbitration section survives termination of these Terms, your account, and any business relationship with TD Service LLC.

Payment Processors & Card Data

TD Service LLC uses third-party payment processors (PayPal, Clover, and similar PCI-DSS compliant providers) to handle all card and digital-wallet payments. We do NOT store full credit/debit card numbers on our servers. Card transactions are tokenized by the processor and only the last 4 digits are retained for receipts and dispute resolution. Disputes regarding card transactions are governed by the cardholder agreement with your card issuer.

Modifications to These Terms

TD Service LLC may modify these Terms at any time. Material changes (changes to refund policy, arbitration, governing law, or any provision affecting your legal rights) will be communicated by: (1) posting a revised version with an updated "Effective Date" at the top, AND (2) where reasonably practical, an email notice to active customers at the address on file. Your continued use of the Site or services after the effective date of a change constitutes acceptance. If you do not agree to a material change, you must stop using the Site and request deletion of your account.

Severability, Waiver & Entire Agreement

If any provision of these terms is found unenforceable, the remaining provisions shall remain in full force and effect, except where the unenforceability of the Class-Action Waiver voids the entire Arbitration section as stated above. No failure or delay by TD Service LLC to enforce any provision is a waiver of that provision. These terms (together with the Privacy Policy, Sweepstakes Official Rules, and any service-specific addenda) constitute the entire agreement between the customer and TD Service LLC and supersede all prior agreements, representations, and understandings.

Assignment. You may not assign your rights or obligations under these Terms without our prior written consent. TD Service LLC may freely assign its rights and obligations, including in connection with a merger, acquisition, sale of assets, or operation of law. Such assignment does not change your rights under these Terms.

Headings. Section headings are for convenience only and do not affect interpretation.

Survival. Provisions intended to survive termination — including Limitation of Liability, Disclaimer of Warranties, Indemnification, Arbitration & Class-Action Waiver, Governing Law, and these miscellaneous provisions — shall survive any expiration or termination of these Terms.
